It becomes (albeit by Code fiat) not a misspelling but 'a correct 
original spelling' and everyone uses it (or misspells it). By the way 
seems the example in the Code took a Commission Case & Opinion to 
resolve — guess it was that 'prevailing usage' stumbling block again 
perhaps. They should have left it alone is my initial reaction. The 
original name is not going away, ever.

Agree it's problematic (hopefully arising in perhaps only rare cases?). 
But in general the random misspellings of the hoi polloi are not 
available names (thankfully).
